This document is issued by Nurse Pro Academy Inc., a corporation incorporated under theBusiness Corporations Act (Alberta), having its registered office in Edmonton, Alberta, Canada (the "Company", "we", "us" or "our"). Part A sets out the Company's Privacy Policy. Part B sets out the Terms of Enrolment applicable to every person who enrols in or pays for the Company's Services. Part C contains provisions common to both.

Part A — Privacy Policy

1. Introduction and Scope

1.1 The Company provides preparatory training for the NCLEX-RN and LPN/CPNRE examinations, preparatory training for nursing licensing examinations of the Middle East (including MOH, DHA, DOH/HAAD and Prometric), and nursing licensure guidance in respect of Canada, the United States of America, Australia and the countries of the Gulf Cooperation Council (collectively, the "Services").

1.2 This Part A (the "Policy") sets out the manner in which the Company collects, uses, discloses, stores and protects personal information, and the rights available to the individual to whom such information relates ("you" or the "User").

1.3 This Policy applies to: (a) the website located at nurseproacademy.ca and all forms hosted thereon; (b) the Company's advertising and lead-generation forms on Meta Platforms (Facebook, Instagram and WhatsApp), Google (Search, Display and YouTube) and any other advertising platform engaged by the Company; (c) the Company's official pages and channels on social media platforms, including Facebook, Instagram, YouTube, LinkedIn, TikTok, X and Telegram; (d) all communication conducted by WhatsApp, electronic mail, telephone or other messaging service; and (e) the Company's online classes, student portal and learning materials (collectively, the "Platforms").

1.4 By accessing or using any of the Platforms, or by submitting personal information to the Company, you acknowledge that you have read and understood this Policy and consent to the collection, use and disclosure of your personal information in accordance with its terms.

  6. Advertising, analytics and technical information, including aggregated and event-level data (such as advertisement-click identifiers) furnished by Meta, Google and similar platforms, together with information collected by cookies and comparable technologies deployed on the Company's website and by embedded YouTube content. The website does not use the Meta Pixel or Google Analytics, or any Google Ads tag. Cloudflare, which delivers the website, counts visits and measures page speed without cookies;
  7. Documentation guidance: the answers you give in a documentation guidance form, and copies of documents you choose to email to us, such as your passport, nursing mark sheets, transcripts, degree or diploma certificates, nursing registration or licence, and a name-change affidavit (see Section 6);

2.2 When you message our Facebook Page or our Instagram account, our automated assistant and our team answer you. Meta sends us the text of your message and an ID number for your chat with us; our system does not read or keep your name, profile picture or anything else from your profile. You can ask for a person at any time. To stop our messages, send STOP in that chat: our assistant then stops writing to you there. If you write to us there again, it replies once to remind you that you can send START to get replies again. 7. the Company's employees, contractors and authorised personnel engaged in enquiry handling, instruction and administration; and
  8. any court, regulator, law-enforcement agency or other authority where disclosure is required by applicable law or legal process.

4.2 Each service provider referred to in Section 4.1 processes personal information under its own privacy terms, and certain of such providers are located outside the jurisdiction in which you reside.

5.1 Where you send or share with the Company, by WhatsApp, electronic mail, direct message, social media or any other means, a photograph, video recording, examination result, screenshot or account of your success, for the purpose of, or in response to a request for, publication on social media or in the Company's promotional materials, you thereby consent to the Company publishing such material, together with your name, in its advertising, on its website and on its social media pages.

5.3 You may withdraw such consent at any time by written notice to the Company at the address set out in Section 21, whereupon the Company shall cease further use of the material. The Company shall use reasonable endeavours to remove material already published; however, the Company cannot guarantee the removal of copies that have been distributed, shared or cached by third-party platforms or other users.

6. Documentation Guidance and Your Documents

6.1 This Section applies to the answers you give in a documentation guidance form and to the copies of documents you send to the Company for documentation guidance (Section 2.1(g)).

6.2 Your choice. Whether you send any document, and which documents you send, is entirely your own choice. The Company asks only for the documents it needs in order to guide you.

6.3 Guidance and mentoring only. The Company uses your answers and documents only to guide and mentor you on your own application. The application is yours: you prepare it and submit it yourself, and the nursing board or other authority concerned makes every decision on it.

6.4 Who sees them. Only the Company's documentation team sees your documents, on a need-to-know basis, and only to guide you.

6.5 No other use. The Company never sells your documents, never publishes them, never uses them for advertising, and never passes them to anyone else, except at your written request or where the law requires it. The providers that host the Company's electronic mail and files (Section 8.1) store them only on the Company's behalf.

6.6 How to send them. Please send documents only by electronic mail to [email protected], and send only the documents your form lists. Please do not send a copy of your full Aadhaar card: a masked Aadhaar, showing only the last 4 digits, is enough. Please do not send any password, including the password of your nursing board account or of any other account.

6.7 How long we keep them. The Company keeps copies of your documents for up to 12 months after your documentation guidance ends, and then deletes them securely. You may ask the Company to delete them sooner at any time, by writing to the address in Section 21; the Company will then delete them, unless the law requires it to keep them.

6.8 Your rights under Section 11, including access, correction and deletion, apply to your documents in the same way as to the rest of your personal information.

7. Third-Party Platforms and Links

7.1 The Platforms may contain links to, or embed content from, third-party websites and services, including without limitation YouTube video content and WhatsApp chat links. Such third parties operate under their own privacy policies, and the Company accepts no responsibility for their collection or processing of personal information.

8. Storage, International Transfer and Security

8.1 Personal information is stored on secure cloud infrastructure operated by providers including Hostinger, Cloudflare and Google (Google Workspace for electronic mail and files), on servers under the Company's control, and within the systems of the platforms identified in Section 4.

8.2 Such infrastructure may be located in Canada, the United States of America, the European Union, India or other jurisdictions. Accordingly, your personal information may be transferred to, stored in and processed in a jurisdiction other than that in which you reside, where it may be subject to the laws of that jurisdiction and accessible to its lawful authorities.

8.3 The Company maintains administrative, technical and physical safeguards appropriate to the sensitivity of the information, including encryption of data in transit, access restricted to authorised personnel on a need-to-know basis, and routine backup procedures. Notwithstanding the foregoing, no method of electronic transmission or storage is entirely secure, and the Company cannot warrant absolute security. Where a breach of security involving personal information under the Company's control creates a real risk of significant harm, or where applicable law otherwise requires it, the Company shall notify the affected persons and the competent authorities in the manner and within the time required by applicable law.

9. Retention

9.1 The Company retains personal information for no longer than is necessary to fulfil the purposes for which it was collected, or as required by applicable law, following which the information is securely deleted or irreversibly anonymised.

9.2 Copies of documents sent to the Company for documentation guidance are kept as set out in Section 6.7.

10. Cookies and Similar Technologies

10.1 The Company's website employs cookies and similar technologies for the purposes described in Section 2.1(f). You may disable cookies through your browser settings; however, certain features of the website may not function correctly as a result.

10.2 When you open a share link sent by one of our students, the website keeps a small first-party cookie that remembers that link for up to 60 days, so that the referral can be recorded if you create an account.

10.3 On your first visit, the website keeps a small first-party cookie (npa_first_touch) for up to 90 days that remembers how you arrived: the campaign tags in the link you opened, the website that sent you and the first page you saw. If you create an account or sign up for a webinar, it is saved with your answer to "How Did You Hear About Us?", only to count where our students hear about us.

11. Your Rights

11.1 Subject to applicable law, you are entitled to:

  1. request access to, and correction or deletion of, the personal information held by the Company concerning you;
  2. withdraw consent to the receipt of WhatsApp messages at any time by replying "STOP", and to the receipt of electronic mail by means of the unsubscribe link contained in each such communication;
  3. manage advertising preferences directly through the account settings of Meta, Google and other platforms; and
  4. lodge a complaint with the competent data protection authority in your jurisdiction.

11.2 Residents of Canada are afforded rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, the Personal Information Protection Act (Alberta). Residents of India are afforded rights under the Digital Personal Data Protection Act, 2023. Residents of the United Arab Emirates, the Kingdom of Saudi Arabia and other member states of the Gulf Cooperation Council, the United States of America and Australia are afforded such rights as are conferred by the personal data protection legislation of their respective jurisdictions. The Company honours all such rights in accordance with applicable law.

11.3 To ask us to delete your personal information, including your chats with us on WhatsApp, Facebook Messenger or Instagram, follow the steps on our How to Delete Your Data page, or email [email protected] with the subject "Delete my data".

Part B — Terms of Enrolment

12. Acceptance

12.1 This Part B (the "Terms") constitutes a binding agreement between the Company and the individual who enrols in, registers for or pays for any of the Services (the "Student").

12.2 By paying any fee, submitting an enrolment or registration, or attending any class, the Student confirms that he or she has read, understood and accepted these Terms and the Policy in Part A.

12.3 The particular programme, its duration, schedule and included materials shall be as communicated to the Student by the Company at the time of enrolment.

13. Fees and No-Refund Policy

13.1 Fees for the Services shall be as quoted to the Student by the Company at the time of enrolment. The Company may revise its fees from time to time; any revision shall apply to new enrolments only.

13.2 All fees paid to the Company are final and non-refundable. No refund, credit or transfer shall be granted in any circumstance, including without limitation the Student's withdrawal, non-attendance, change of personal circumstances, change of examination plans, dissatisfaction with the Services, or failure to pass any examination.

13.3 Where the Student pays in instalments, the Student remains liable for all outstanding instalments notwithstanding withdrawal or non-attendance, unless otherwise agreed by the Company in writing.

14. No Guarantee of Examination Results or Licensure

14.1 The Company provides preparatory training and guidance only. The Company does not administer any examination and has no control over any examination board, nursing regulatory body, immigration authority or employer.

14.2 The Company makes no representation, warranty or guarantee that the Student will pass any examination, obtain any licence, registration or credential, secure any employment, or obtain any visa or immigration status. Any statement of past student outcomes is historical and is not a promise of future results.

14.3 The Student is solely responsible for verifying and satisfying the eligibility, application, documentation and fee requirements of the relevant examination board, regulatory body and immigration authority.

14.4 Documentation guidance is guidance and mentoring only. The Student decides what to share, prepares and submits their own application, and the relevant board or authority makes every decision.

15. Learning Materials and Intellectual Property

15.1 All class recordings, notes, question banks, mock examinations, slides and other materials provided by the Company (the "Materials") are and remain the intellectual property of the Company or its licensors.

15.2 The Materials are licensed to the Student for personal, non-commercial study only. The Student shall not copy, record, share, sell, publish, distribute or otherwise make the Materials available to any other person, whether or not for payment. Access to the Materials is personal to the Student and may not be shared.

15.3 Breach of this Section entitles the Company to terminate the Student's enrolment immediately without refund and to pursue any other remedy available at law.

16. Conduct and Attendance

16.1 The Student shall attend classes punctually, conduct himself or herself respectfully towards instructors and other students, and refrain from any recording of live classes except as expressly permitted by the Company.

16.2 The Company may remove from any class, or terminate the enrolment of, a Student whose conduct is disruptive, abusive or in breach of these Terms, without refund.

17. Schedule Changes

17.1 The Company may reschedule classes, substitute instructors, or change the mode of delivery where reasonably necessary. Where a scheduled class cannot be delivered, the Company shall provide a replacement class or a recording.

18. Limitation of Liability

18.1 To the fullest extent permitted by law, the Company's total liability to the Student arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the fees actually paid by the Student for the programme concerned.

18.2 The Company shall not be liable for any indirect, consequential or economic loss, including without limitation loss of income, examination fees, travel or immigration costs, or loss of opportunity.

20.1 This document shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, and the courts of Alberta shall have exclusive jurisdiction over any dispute arising hereunder.

21. Contact

21.1 All enquiries, requests and notices under this document shall be directed to the Company by electronic mail at [email protected] or by WhatsApp at +91 99462 65305.
